TERMS & CONDITIONS
1. Failure to sign this confirmation or non-payment of deposit dose not cancel
this engagement.
2. Either party may terminate this agreement with written notice by certified
mail up to twenty-eight (28) days before the day of service. Where cancellation
is made it is deemed to have been given on the day it was sent by the venue. Any
cancellation sent after this time will be treated as a breach of contract and
the venue will be liable for payment of the full contractual fee.
3. Arthamus has the right to cancel their performance at any time if medical
advice by their doctors states they are not fit to perform, if this situation
arises the performance will be rescheduled to a date that is convenient for both
parties.
4. Any special conditions attached shall not be formed in such a way as to
breach the appropriate award conditions and/or employment relevant to the
contracting parties.
5. Responsibility for maintenance of safe working conditions lies solely with
the venue. Unsafe working conditions will represent a breach of this agreement
by the venue and attract liability for the full contractual fee. The appropriate
legal tribunal shall determine all other claims relating to safety and/or
damages.
6. All monies will be in the form of cash payment immediately after the
performance unless otherwise pre-arranged.
7. The venue agrees to obtain & comply with all permits, licenses & consents
applicable to this performance.
8. The venue agrees to allow Arthamus unrestricted and exclusive right to sell
their merchandise before, during and after each performance.
9. Arthamus is allowed ten (10) guests to each performance.
10. The venue agrees to provide a proper number of attendants and stewards to
supervise the venue and prevent entry of undesirables and ensure proper conduct
of the audience.
11. Accommodation provided by the venue should be of good quality motel style.
The venue is required to pay the room tariff only.
12. The terms ‘performer’ and ‘venue’ refer to the contracting parties in this
agreement for provision of musical services. An agent may represent either the
venue of the performer but is not a party to the contract. Where a theatrical
employer or promoter is a signatory, obligation in Clause four (4) may, by law,
involve parties outside the contract. Anyone questioning such terms should
consult the appropriate organisations.
13. Failing to sign and return this agreement dose not cancel this agreement.
